1. Introduction
Welcome to PlainNoteBook ("we," "our," or "us"). These Terms & Conditions ("Terms") dictate your engagement with our yacht charter services and our website hosted at plainnotebook.sbs (the "Service"), operated by PlainNoteBook.
By securing a charter or utilizing our Service, you consent to adhere to these Terms. Should you not agree with any section of these terms, you are not permitted to use the Service.
2. Service Overview
PlainNoteBook offers upscale yacht charter services which encompass:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Service availability is contingent on several factors, and we maintain the discretion to alter or discontinue services as needed.
3. Booking and Reservations
3.1 Booking Process
Charter booking prerequisites include:
- Minimum age of 18 years
- Submission of accurate and complete information
- Advance payment of a specified deposit as per your booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is secured only after the payment is received along with our written confirmation. We reserve the prerogative to decline service to anyone at our discretion.
3.3 Availability
Charters depend on the availability of the vessel and suitable weather conditions. We will exert reasonable efforts to accommodate your requested dates and times.
4. Payment Terms
4.1 Pricing
All pricing is presented in € and encompasses applicable taxes unless specified otherwise. Prices are subject to alterations without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the total charter cost due at the time of booking
- Balance: Required 48 hours prior to the charter departure
- Subsequent charges (if any): Payable at the end of the charter
4.3 Payment Methods
We accept various payment methods, including major credit cards, bank transfers, and certified cheques. Payments are securely processed using encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled more than 72 hours before departure: Full refund minus any processing fees
- Between 24 to 72 hours before departure: 50% refund
- Less than 24 hours before departure: No refund is provided
5.2 Weather Cancellations
Should the weather be deemed unsafe for sailing by our captain, you will receive the option to:
- Rebook your charter for the next available slot without additional cost
- Obtain a full refund if rebooking is not a viable option
5.3 Mechanical Issues
In case of mechanical issues with the assigned vessel, we will strive to offer a suitable replacement. If a substitute vessel is not available, a full refund will be granted.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to all instructions provided by the crew
- Wear any necessary safety gear as required
- Inform about any medical conditions that could impact their safety
- Stay within the designated areas on the vessel
6.2 Prohibited Items
Certain items are prohibited on board, including:
- Glass containers
- Illegal substances
- Firearms or weapons
- Excessive beverages (exceeding reasonable consumption)
- Pets (unless pre-approved)
6.3 Conduct
Guests must behave in a polite and respectful manner. We reserve the right to conclude a charter ahead of schedule without refund if a guest's conduct endangers safety or interrupts others' enjoyment.
7. Liability and Insurance
7.1 Our Liability
Our accountability is limited to the amount you have paid for the charter. We are not liable for:
- Personal injuries resulting from passenger’s own negligence
- Loss or damage to personal belongings
- Indirect, unforeseen, or punitive repercussions
- Delays due to weather or factors outside our governance
7.2 Insurance Coverage
Comprehensive marine insurance is sustained for our vessels and operations. It is the responsibility of passengers to ensure their own travel and personal insurance.
7.3 Assumption of Risk
By engaging in our charter services, you recognize that maritime activities carry inherent risks, accepting personal responsibility for your safety and welfare.
8. Modifications and Itinerary Changes
Based on weather, safety, or operational necessities, we hold the authority to modify itineraries, paths, or schedules. Persistent efforts will be made to provide comparable alternatives.
9. Force Majeure
We are exempt from accountability for delays, cancellations, or changes resulting from events beyond our control, these can include but not limited to:
- Extreme weather events
- Natural catastrophes
- Legislative actions
- Port shutdowns
- Mechanical faults
10. Privacy and Data Protection
Your private data is handled as per our Privacy Policy standards. By engaging our services, you agree to the gathering and usage of your data as outlined in our Privacy Policy.
11. Intellectual Property
All materials featured on our website, including but not limited to text, visuals, logos, and photographs, are guarded by copyright and intellectual property regulations. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our explicit consent.
12. Governing Law
These Terms are subjected to the governing laws in France. Any legal disputes will be settled in courts based in Cannes, France.
13. Changes to Terms
